Losing a loved one as a result of a preventable accident or another person’s wrongful acts is a traumatic experience. Those who survive the decedent will likely suffer emotional harm and grief for years. They may also incur numerous financial expenses, ranging from the value of the decedent’s lost wages to funeral and burial expenses and more.
Per South Carolina Code Section 15-51-10, “whenever the death of a person shall be caused by the wrongful act, neglect, or default of another,” a civil action for wrongful death is appropriate. A wrongful death claim allows beneficiaries to recover compensation for damages suffered as a result of the death.
